Former Idaho Falls Prosecutor Kimball Mason will be sentenced today on three felony charges.
Mason pleaded guilty last month to two counts of grand theft and one count of falsifying a public document. Under Idaho Code, each conviction carries a maximum punishment of 14 years in prison.
However, in accordance with
a plea deal arranged between Fred Hoopes, Mason's attorney, and the Idaho attorney general's office, the prosecution said it would recommend 12 months in a county jail.
Retired 6th District Judge William Woodland, who's presiding over the case after all five judges in the 7th Judicial District recused themselves, said he is not bound by the terms of the agreement between the state and Mason, although he would likely abide by it.
Woodland said Mason would be given a chance to withdraw his plea if the judge gives him a harsher sentence than was agreed upon.
The charges Mason pleaded to stem from guns and other evidence he stole from the Idaho Falls Police Department's evidence locker.
The hearing will be held at 10 a.m. in the Centennial Courtroom at the Bonneville County Courthouse, 605 N. Capital Ave.
