PRESTON — The Franklin County prosecutor is reviewing an alleged battery incident following the death of the 77-year-old victim.
Preston resident Don Bath, who was critically injured in the July 9 incident, died at Franklin County Medical Center this past weekend.
Preston resident Jareth K. Christensen, 25, was charged earlier with felony aggravated battery for beating Bath and was booked into the Cache County Jail in Logan, Utah, on a $5,000 bond.
Preston Police Chief Dan McCammon said the county prosecutor is reviewing that charge following Bath’s death. As of Thursday, no decisions had been made about whether or not that charge would be amended.
Preston police and Franklin County sheriff’s deputies were dispatched to the reported battery at a West Oneida Street residence shortly before 5:30 a.m. July 9.
Authorities aren’t releasing many details about the incident since the case remains under review. But according to family members, Bath, who had dementia, was confused about the time he needed to be at a doctor’s appointment. He encountered Christensen near his home, flashing a light in Christensen’s eyes, police said.
Authorities said Bath was then beaten, resulting in him being hospitalized.
If convicted of aggravated battery, Christensen faces up to 15 years in prison.
